Acceptable Use Policy

1. Introduction

This Acceptable Use Policy (“AUP”) governs the use of the FleetOS platform, website, mobile applications, and all related services (collectively, the “Services”) provided by Nomad Logistics Dispatch LLC, a limited liability company (“FleetOS,” “we,” “us,” or “our”).

This AUP is incorporated by reference into our Terms of Service. By using our Services, you agree to comply with this AUP. Violation of this AUP may result in suspension or termination of your account without refund.

We reserve the right to modify this AUP at any time. Material changes will be communicated via email or through the Services. Your continued use of the Services after such modifications constitutes acceptance of the updated AUP.

2. General Conduct Requirements

When using our Services, you agree to:

  • Comply with all applicable federal, state, and local laws and regulations
  • Comply with all applicable Department of Transportation (DOT) regulations
  • Comply with Federal Motor Carrier Safety Administration (FMCSA) requirements
  • Provide accurate, current, and complete information in all records you create
  • Maintain the security of your account credentials and those of any users you invite
  • Use the Services only for legitimate transportation management and dispatch operations
  • Treat FleetOS staff, other users, carriers, drivers, and third parties with respect
  • Report any security vulnerabilities or bugs you discover to support@fleetos.pro

3. Prohibited Uses

The following categories of use are strictly prohibited on the FleetOS platform.

3.1 Illegal or Harmful Activities

  • Violate any applicable law, regulation, or ordinance
  • Facilitate or enable illegal transportation activities
  • Arrange the transport of hazardous materials without proper licensing and documentation
  • Evade or circumvent DOT, FMCSA, or other regulatory requirements
  • Generate fraudulent IFTA reports or falsify fuel tax documentation
  • Create false or misleading compliance records of any kind
  • Facilitate insurance fraud, workers’ compensation fraud, or cargo fraud
  • Launder money or engage in financial crimes
  • Facilitate human trafficking, smuggling, or the transport of illegal substances

3.2 Fraud and Misrepresentation

  • Create accounts using false, misleading, or stolen identities
  • Impersonate another person, company, carrier, driver, or FleetOS staff
  • Falsify DOT numbers, MC numbers, or operating authority information
  • Create fraudulent invoices, statements, or billing records
  • Manipulate load data, mileage, or revenue figures for fraudulent purposes
  • Submit false fuel purchase records or expense claims
  • Misrepresent driver qualifications, CDL status, or certifications
  • Falsify vehicle inspection records, maintenance logs, or safety documentation
  • Create fictitious broker or shipper relationships

3.3 Security Violations

  • Attempt to gain unauthorized access to our systems, data, or another organization’s FleetOS workspace
  • Access or attempt to access another user’s account
  • Circumvent, disable, or interfere with authentication, billing gates, rate limits, or other security controls
  • Probe, scan, or test the vulnerability of our systems without prior written authorization
  • Deploy malware, viruses, ransomware, or other malicious code
  • Conduct denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks
  • Intercept or monitor network traffic or data not intended for you
  • Forge request headers or manipulate identifiers to disguise origin or identity
  • Use automated tools to scrape, crawl, or harvest data from the platform beyond our published API limits
  • Reverse-engineer, decompile, or disassemble the FleetOS platform or its components

3.4 Abuse and Harassment

  • Harass, bully, intimidate, or threaten any carrier, driver, team member, or FleetOS staff
  • Send spam or unsolicited bulk communications through platform messaging features
  • Collect or harvest personal information about carriers or drivers without their consent
  • Post or transmit defamatory, obscene, or offensive content within the platform
  • Discriminate against individuals based on protected characteristics
  • Interfere with other organizations’ use of the Services

3.5 Intellectual Property Violations

  • Infringe on copyrights, trademarks, patents, or trade secrets belonging to FleetOS or any third party
  • Copy, modify, or distribute FleetOS software or documentation without authorization
  • Remove or alter proprietary notices, labels, or branding from any platform output
  • Use FleetOS trademarks, logos, or branding without prior written permission
  • Create derivative works based on the FleetOS platform or its underlying systems

3.6 System Abuse

  • Use the Services in a manner that significantly exceeds reasonable usage patterns for your subscription tier
  • Intentionally consume excessive computational resources, storage, or bandwidth
  • Attempt to circumvent usage limits, subscription restrictions, or billing controls
  • Share account credentials or API tokens with unauthorized parties outside your organization
  • Resell, sublicense, or commercially exploit FleetOS access without our prior written authorization
  • Use automated systems or bots except where expressly permitted
  • Interfere with the proper functioning or availability of the Services

4. Trucking Industry-Specific Prohibitions

Given the heavily regulated nature of the commercial trucking industry, the following specific prohibitions apply to all FleetOS users.

4.1 Regulatory Compliance Records

  • Creating or storing records intended to deceive DOT auditors or FMCSA compliance reviewers
  • Generating false hours-of-service (HOS) documentation or ELD records
  • Falsifying driver qualification files (DQ files) or employment verification records
  • Creating fictitious drug and alcohol testing records
  • Misrepresenting safety ratings, CSA scores, or violation history
  • Producing fraudulent weight tickets, bills of lading, or proof-of-delivery documents
  • Creating false proof of insurance or liability coverage documentation

4.2 IFTA and Fuel Tax Compliance

  • Intentionally entering false mileage data to reduce IFTA tax liability
  • Creating fictitious fuel purchase records or manipulating gallons reported
  • Falsifying state mileage allocations to shift tax burden fraudulently
  • Generating IFTA quarterly reports you know to contain materially false information
  • Using FleetOS to facilitate any fuel tax evasion scheme

4.3 ELD and Telematics Data

  • Connecting ELD or telematics integrations using credentials you are not authorized to use
  • Manipulating, altering, or suppressing ELD data feeds to misrepresent driver activity
  • Using GPS tracking data for purposes outside of legitimate fleet management within your organization
  • Sharing driver location data with unauthorized third parties without driver consent

4.4 Driver and Vehicle Records

  • Recording drivers as active when their CDL is invalid, suspended, or revoked
  • Falsifying medical certificate (DOT physical) records or expiry dates
  • Creating false vehicle maintenance or Annual Inspection histories
  • Recording vehicles that do not meet applicable federal safety standards
  • Concealing out-of-service violations, orders, or accident history

5. Data and Content Standards

5.1 Data Accuracy

You are responsible for the accuracy and completeness of all data you enter into the Services. You agree to enter accurate information for all business records, promptly update records when information changes, verify the accuracy of generated reports before submission to any authority, and maintain supporting documentation for data entered into the platform.

5.2 Document Uploads

When uploading documents, images, or attachments to FleetOS, you agree to:

  • Only upload documents you have the right to store and process
  • Not upload files containing malware, viruses, or malicious code
  • Not upload content that violates any law or third-party intellectual property rights
  • Ensure uploaded documents are authentic and unaltered, except where redaction is legally required
  • Only upload content relevant to your transportation and logistics operations

5.3 Communications

Messages sent through FleetOS’s internal messaging features must be professional and relevant to dispatch, carrier, or driver operations. You may not use messaging features to send unsolicited promotions, harassing content, or communications unrelated to your transportation business.

6. Account Security Requirements

You are responsible for maintaining the security of your account and all accounts within your organization. You agree to:

  • Use a strong, unique password for your account
  • Not share your login credentials with individuals outside your authorized team
  • Immediately notify us at support@fleetos.pro of any unauthorized access or suspected security breach
  • Log out of your account when using shared or public devices
  • Keep your contact information and email address current
  • Review account activity and user access regularly
  • Remove dispatcher or team member access promptly when an individual leaves your organization

You are responsible for all activities that occur under your organization’s FleetOS account, whether or not you personally authorized those activities.

7. Reporting Violations

If you become aware of any violation of this AUP — including unauthorized access, data misuse, fraudulent records, or harmful content — please report it to us immediately:

We investigate all credible reports and take appropriate action, which may include suspending or terminating accounts, reporting violations to law enforcement, or other measures we deem necessary.

8. Enforcement

8.1 Investigation

We may investigate suspected violations of this AUP. During an investigation, we may:

  • Review your account activity, records, and uploaded content
  • Temporarily suspend your access to the Services while the investigation is ongoing
  • Request additional information or documentation from you
  • Cooperate with law enforcement if required by law or if criminal activity is suspected

8.2 Consequences of Violation

Depending on the nature and severity of a violation, consequences may include:

  • Warning: A formal notice for minor or first-time violations
  • Temporary Suspension: Restriction of access while you remedy the violation or during investigation
  • Account Termination: Permanent removal of access to the Services without refund
  • Legal Action: We may seek damages, injunctive relief, or other legal remedies as permitted by law
  • Law Enforcement Referral: We may report violations involving illegal activity to appropriate authorities

8.3 No Refunds for Policy Violations

If your account is terminated due to a violation of this AUP, you will not receive any refund of subscription fees or other amounts paid. You remain responsible for any amounts owed prior to termination.

9. Modifications to This Policy

We reserve the right to modify this AUP at any time. When we make material changes, we will update the effective date at the top of this page, notify you via the email address associated with your account, and post a notice within the FleetOS application. Your continued use of the Services after the effective date of any changes constitutes your acceptance of the modified AUP.
